Land Acquisition Laws of Land

Registration Act of 1908 was amended in December 2004. The Act came into force on July 1, 2005.

According to the new law, the requirements of the buyers and sellers during land registration are:

(1) Both the buyer and the seller will give their own signatures / tips associated images.

(2) Draw a map with the description of the property.

(3) The buyer has to give affidavit regarding property ownership.

(4) The ownership of the land for which the land was acquired for the last 25 years has to be submitted.

(5) If the value of land is less than Tk 5 lakh then the registration fee will be 500 taka, 5 lakh to 50 lakh, the registration fee is 1000 taka, the land value of more than 50 lakh, the registration fee is Tk 2000.

(6) Whatever the value of land inherited, the registration fee will be Rs 100.

(7) All contracts for land transfer must be written and registration is mandatory.

(8) The contract for purchase of land will now be effective for one year from the date of execution of the contract.

(9) Registration of property sale agreements has to be registered, the agreements which are not yet registered will be registered within six months of the date of the enactment of this Act.

(10) In case of mortgagee land, mortgage holder can not be pledged or sold to anyone other than written consent.

Land Acquisition:

First try to get the possession of the land, but do not forget to create chaos. If the failure to take possession, tell the local chairman or the problem of the people.

If you do not solve it, make a GD to the local police station.

Get to the local civil court

(Prevention of Prevention Act - 1877, 9) The case will be filed in 6 months of the land acquisition.

Suicides can be filed in criminal court (get remedy under Section 145 of the Criminal Procedure Code 1898). The land will have to be filed within two months of the Vedakhal.

Get help from an experienced lawyer.

Remember, the civil case takes a little more time, so patiently handle the case.
