The central today propposed rules for a "no- fly list" ,the first of its kind in the world,that allow airlines to ban unruly passengers from flying for up to years.The rules were issued months after a parliamentarian was caught on camera assaulting an airline crew member for not being able to provide him a business class seat in an all-economy flight
REVISED RULES
The DGCA has revised the relevant sections of the civil Aviation Requirement (CAR section 3,series M, part vi on "Handling of Unruly Passengers) to bring in a deterrent for passengers who engage in unruly behaviour on board aircrafts.The revision has been done in accordance with the provisions of Tokyo Convention 1963.
What is Tokyo Convention
The Convention On Offences and Certain Other Acts Committed On Board Aircraft ,commonly called the Tokyo Convention,is an international treaty ,concluded on 4 December 1969 ,and as of 2015 has been ratified by 186 parties.
The three categories of penalty
LEVEL 1- Unruly physical gestures ,verbal harassment and unruly inebriation
Ban-upto 3 months.
LEVEL 2-physically abusive behaviour (Pushing,kicking ,hitting ,inappropriate touching)
Ban-upto 6 months
LEVEL 3-Life threatening behaviour -assaults , damage to aircraft systems etc.
Ban-Minimum 2 years.

Need to be filed by the pilot -in-command .These complaints will be probed by an internal committe to be set up by the airline.the internal committe will have retired District and sessions judge as chairman and representatives from a different scheduled airline ,passengers 'association /consumer association/retired officer of consumer Dispute Redressal Forum as Members
Work of committe
To decide the matter within 30 days,and also specify the duration of ban on the unruly passengers.During the period of pendency of the enquiry,the concerned airline may impose a ban on the said passenger.For every subsequent offence ,the ban will be twice the period of previous ban.The airlines will be required to share the No-Fly list, and the same will be available on DGCA website ,The other airlines will not be bound by the No-Fly list of an airline.
