Tort is a civil wrong, it is a breach of duty that the law imposes on persons who stand in a particular relation to one another.
Tort is different from breach of contract where liability arises from the agreement between parties. Besides, in criminal law, liability must be imposed by the state, where as in tort liability is judge-made.
Tort is also a part of private law while criminal law is an aspect of public law. In Tort damages are unliquidated. Unliquidated damages are damages which cannot be determined by a fixed formula and must be established by a judge or jury. while liquidated damage which is obtained in contract is an amount contractually stipulated as a reasonable estimation of actual damages to be recovered by one party if the other party breaches
