Using the same scale classification, can anyone lend me their thoughts on NAV and ARK?

I've taken an interest in NAV but right off the bat of their homepage, they're talking about getting 5% interest when you switch to a "stake mode". Based on what I've just read about the Howey test, does this coin seem "Likely"?
