That's partially true - he would have become insolvent because of the costs of court and lawers and Royalities respectively compensation for Copyright missuse... but there was a peaceful agreement outside court like I described (25% to the photographer, 75 % to the macaque and his representative, the animal rights organisation ;) ) - as the picture went viral through a lot of media the photographer retired ;) so win win - big deal for everyone - hahaha ;)
