In the trial of the 7 bishops, we learn that historically people, prior to the habeas corpus acts of 1676, were just given a summons for an alleged misdemeanor [and wouldn't be tried until the next term]. They would not be detained unless there was a failure to appear, or upon a conviction.

They also are obligated to give their names.
