Una frase dello scrittore e drammaturgo ceco, Karel Capek, mi è rimasta impressa fin dai tempi della scuola:

Immagini il silenzio se tutti quanti parlassero solo di ciò che sanno?

Queste parole sono estrapolate da quello che è considerato uno dei primissimi esempi di dramma fantascientifici, "R.U.R." (Rossum's Universal Robots), di certo l'opera più famosa di Capek, e sta chiaramente ad indicare la pretesa di molte persone di voler esprimere il proprio parere anche su argomenti non di loro competenza.

Un po' tutti, chi più, chi meno, ci siamo probabilmente avventurati qualche volta ad esprimere giudizi di pancia, su argomenti e tematiche sulle quali non eravamo esattamente ferrati, magari ripetendo a pappagallo tesi sentite pronunciare qua e là da qualcuno che reputavamo competente, ma che in realtà ne sapeva anche meno di noi.

Niente di male, non si può di certo essere preparati in tutto e disporre di una conoscenza onnisciente, ma a volte potrebbe risultare più saggio mordersi metaforicamente la lingua, magari per evitare di andare incontro a possibili brutte figure o ad essere smentito con grande facilità.

Non so se il procuratore federale, Giuseppe Chiné, sia a tal punto appassionato di fantascienza da aver letto le opere di Capek e da esse lasciarsi ispirare, ma una cosa è certa: il suo silenzio di questi giorni sta facendo più rumore di un'altra qualsivoglia arringa fantascientifica, che presto verrà da egli partorita ed elaborata dai compagni di merende della nuova Corte d'Appello federale.

Se l'appuntamento con la seconda probabile penalizzazione della Juventus è già stato fissato per la serata del 22 maggio (ma c'è da giurarci che la sentenza arriverà il 23, in modo da buttare dentro al calderone anche gli eventuali punti raccolti dai bianconeri ad Empoli), poco o nulla si sa dell'altro filone di indagine, quello sulla cosiddetta manovra stipendi.

Per il "gravissimo illecito" che ha portato la società bianconera allo spostamento da un bilancio all'altro di alcune passività (gli stipendi da corrispondere ai calciatori), in fase di chiusura delle indagini il procuratore federale, aveva invocato la violazione dell'ormai arcinoto articolo 4, quello sulla lealtà sportiva (sebbene ne esista uno specifico, l'articolo 31, che norma la materia economica).

La notifica di chiusura delle indagini è stata inviata dalla procura della FIGC in data 12 aprile e da quel momento in poi il procuratore federale avrebbe dovuto rendere noto, in un periodo massimo di trenta giorni, le decisioni intraprese, che potevano prevedere un nuovo deferimento (rinvio a giudizio) del club bianconero o l'archiviazione.

All'alba del 17 maggio tuttavia, ancora tutto tace. Nessuna voce ufficiale, anche se si suppone che Chiné abbia richiesto una proroga di quindici giorni, piuttosto inusuale, se si considera il prolungarsi delle indagini iniziate addirittura l'anno scorso. Sembra evidente ai più che qualcosa stia bollendo in pentola, ma al momento attuale appare difficile prevedere se la notizia possa rivelarsi positiva o negativa per il club.

I più ottimisti parlano di un Chiné in grande difficoltà nel portare avanti la richiesta di deferimento in base alla violazione dell'articolo 4, già contestato e giudicato con la questione plusvalenze, per l'evidente violazione del principio giuridico del ne bis in idem (non si può essere giudicati due volte sullo stesso fatto). Plusvalenze e manovra stipendi apparterrebbero infatti ad un unica generica accusa di slealtà, tale da non permettere una nuova imputazione.

Tuttavia non sono in pochi a pensare, compreso chi vi scrive, che ragionare in punta di diritto sia ormai esercizio inutile e che la vicenda Juventus appare ogni giorno che passa sempre più politica. E' probabile che Chiné attenda di conoscere la sentenza sulle plusvalenze per tarare alla bisogna una seconda penalizzazione, che terrebbe la squadra fuori anche dalle posizioni che garantirebbero l'accesso all'Europa League.

Ad essa si aggiungerebbe poi l'eventuale squalifica dell'UEFA da tutte le competizioni europee (per una o forse addirittura due stagioni), che partirebbe dalla prima qualificazione della Signora ad una delle sue competizioni. Insomma uno scenario che potrebbe prevedere anche tre anni senza coppe.

Colpirne uno per educarne cento.

Nothing wrong with that, one certainly cannot be knowledgeable in everything and have omniscient knowledge, but sometimes it might be wiser to bite one's tongue metaphorically, perhaps to avoid the possibility of making a bad impression or being so easily disproved.

I don't know if the federal prosecutor, Giuseppe Chiné, is such a fan of science fiction that he has read the works of Capek and let himself be inspired by them, but one thing is certain: his silence these days is making more noise than any other science fiction argument, which will soon be drafted by him and elaborated by his comrades in arms in the new Federal Court of Appeal.

If the appointment with the second probable penalisation of Juventus has already been set for the evening of 22 May (but we can be sure that the sentence will arrive on the 23rd, so as to throw into the cauldron any points collected by the Bianconeri at Empoli), little or nothing is known about the other line of investigation, that on the so-called salary manoeuvre.

For the 'very serious offence' that led the Juventus club to move from one balance sheet to another some liabilities (the salaries to be paid to players), the federal prosecutor, at the closing stage of the investigation, had invoked the violation of the now familiar Article 4, the one on sporting loyalty (although there is a specific one, Article 31, which regulates economic matters).

The notification of the closure of the investigation was sent by the FIGC public prosecutor's office on 12 April and from that moment on, the federal prosecutor should have made known, within a maximum period of thirty days, the decisions taken, which could include a new referral (committal for trial) of the Juventus club or archiving.

At dawn on 17 May, however, all is still silent. No official word, although it is assumed that Chiné has requested a fifteen-day extension, which is rather unusual considering the prolonged investigation that began as long ago as last year. It seems obvious to most that something is boiling in the pot, but at the moment it seems difficult to predict whether the news will turn out to be positive or negative for the club.

The most optimistic speak of a Chiné in great difficulty in pursuing the referral request on the basis of the violation of Article 4, already contested and judged with the capital gains issue, due to the obvious violation of the legal principle of ne bis in idem (one cannot be judged twice on the same fact). Capital gains and salary manoeuvre would in fact belong to a single generic accusation of disloyalty, which would not allow a new indictment.

However, there are not a few who think, including this writer, that reasoning in point of law is now a useless exercise and that the Juventus affair appears more and more political with each passing day. It is likely that Chiné is waiting to hear the ruling on capital gains in order to calibrate a second penalty, which would also keep the team out of the positions that would guarantee access to the Europa League.

To this would be added the possible disqualification of the UEFA from all European competitions (for one or perhaps even two seasons), which would start from the Lady's first qualification to one of its competitions. In short, a scenario that could involve as many as three years without cups.
