Cryptocurrency was born with the aim of creating a completely independent and free financial system outside the traditional legal framework. However, when the size of this market reaches trillions of dollars and billions of ordinary people around the world start investing in it, government intervention becomes inevitable in the interests of preventing fraud, stopping tax evasion, and protecting investors. The process of determining these legal rules and regulations in the crypto world is called cryptocurrency regulation. And the most powerful and discussed institution on the world stage that is leading this regulation or control fight is the US SEC or Securities and Exchange Commission. The main responsibility of the SEC is to regulate the US capital market and protect the interests of ordinary investors. In the case of cryptocurrency, the main claim of the SEC is that most of the cryptocurrencies or tokens on the market are not actually ordinary currencies, but rather, they are investment contracts like 'securities' or shares. To determine this, they use a traditional legal formula called the Howey Test. According to the SEC, if a project raises funds from the general public with the promise that the price of that token will increase in the future and investors will benefit from their collective talent and labor, then it must be considered a security. And if a cryptocurrency is proven to be a security, then its legal registration is mandatory according to the SEC's rules. This legal interpretation has led to a fierce legal battle between the SEC and the big giants of the crypto world in the past few years. The SEC has filed lawsuits against major crypto exchanges and projects such as Ripple (XRP), Coinbase, and Binance for selling securities without registration. Due to the SEC's strict stance, there has often been a major price drop or volatility in the crypto market. However, with the change of time, there has also been some change in the wind in the sails of this strict regulation. After a long legal process and scrutiny, the historic approval of spot Bitcoin and ether ETFs (exchange-traded funds) has turned the tide of this legal battle. The biggest positive aspect of crypto regulation and this strictness by the SEC is that it brings a kind of institutional credibility and security to the market. When the general public knows that a project is under legal supervision, the risk of Ponzi schemes or large-scale fraud decreases and large institutional capital from Wall Street starts entering the market. However, a large part of the crypto community strongly criticizes this repressive policy of the SEC. According to them, it is extremely unreasonable to try to regulate an innovative sector like modern blockchain technology with old laws from the 1930s. Due to these strict regulations, many emerging technology and startup companies are leaving America and moving to other countries, which is hindering the development of the technology. In short, cryptocurrency regulation and the role of the SEC are an eternal struggle for a new technology to mature. The crypto world wants to retain its primitive wild freedom, while the government wants to give it a disciplined form within the chains of law. It is through the conflict of these two opposing ideals that a balanced legal framework of the future is being determined, which will be able to ensure the highest security of the digital assets of the common people without undermining the freedom of innovation.
