Colorado bans CBD sales.

in #cbd8 years ago (edited)

Greetings Liberty Lovers,

For those of you who follow me on social media, its no surprise if I say to you that I have been dealing with a lot of crazy circumstance. As you know, I'm a hemp entrepreneur in the CBD market. Today I will publish what that crazy circumstance is exactly. On July 19th I got to read this wonderful email.

So naturally, being directly impacted by what is happening here I had to attend. I was able to obtain documentation of what the background was behind this situation. The effects are drastic to put it lightly.

As you can clearly see, this has the potential to put many people in the hemp industry out of business rather quickly.

What good is cultivation if you aren't allowed to sell your products?

Here is a copy of the email correspondence.

So after this meeting the hemp community in Colorado was supposed to get together with one another so the industry could address the state on a reasonable way to proceed forward so that the state's concerns could be addressed while still allowing the hemp industry to not lose its most significant avenue for sales......

About that:

So with all this information we now know that the FDA is trying to essentially ban CBD sales with the justification that CBD is an adulterated substance. But there is one problem with that, the results of testing that I have prove that these products are safe. Not just safe to be consumed, but the science also proves that the technique that we use (the same that commercial kitchens would employ) produces a safe product.

Now these standards of testing are for medical marijuana. As you can see, this method and product meet and exceed standards set by the medical marijuana market. Food standards are far less stringent. That doesn't mean they are less important, it just simply means that one doesn't need to meet such complex standards to create a product safe for human consumption. There is no reason for the Colorado Department of Health and Environment to be taking cannabis related guidelines from the FDA when the stance of the federal government is in clear opposition to Cannabis law in Colorado. This is nothing more than the FDA trying to ban products they don't like. The data here is clear. The FDA is trying to influence the Colorado markets.

I'm not sure how well these photos will come out in the final post. They are all also posted here:

That's the problem with legalization/regulation. You're not wrong about your product, Kush, but if you let statists keep an inch, they're going to take a mile.

You're absolutely right.

It was awesome in Colorado when the Supreme Court basically legalized Medical Marijuana. Due to the court ruling, there was literally a near free market to marijuana business, with the exception being consumers needed to buy a $90 medical license to purchase marijuana.

At that time, the business was amazing, service was amazing. Prices plummeted, and state regulation was non-existent. For about 2-3 years the Marijuana industry flourished in a manner that truly made me proud of the free market. Then the state government got involved, and ever since then, prices went up, taxes went up, products began to be tightly controlled. Businesses were mandated to have absurd expensive chemical testing of their products. Once the government got involved, the black market sprang back up. And now, if you want the best deal for products, you must buy on the black market.

This is absolutely true. All the state's efforts have done is created a black market by driving up the costs of operations so high that the average person could never hope to afford to get into the legal market. Now people do what they did when it was illegal, grow the shit and sell it anyways.

The FDA has recently just approved another verision of synthetic cannabinoid in a liquid form...ya know like the synthetic cannabinoids used in "synthetic marijuana" the stuff that has been sending people to the hospital in masses and killing countless others......I can only imagine how much money went into producing this fake chemical and worse the cost to the patient....the government would rather see people die then have to admit that the laws on marijuana are ignorant and wrong and need to be changed...they just fear the countless people in jail some for life for possessing marijuana a natural grown herb

Statists certainly initiated this problem by asking for permission when none was needed. But there is big money on the federal level that is being spent to close all these sales avenues because threat to profit.

Why doesn't the Colorado government pass a law stating that Cannabis is not subject to food safety or exempt growers from complying with those laws? Sort of like cottage food laws - unless you're wholesaling, you're pretty much exempt from health laws.

Or, the Colorado government can tell the FDA to stick it and tell them that they are not welcome to interfere in their residents' affairs.

Either way, the FDA complaints shouldn't matter - just like the DEA's rules shouldn't matter. If it's a state issue for one, then it's a state issue for the other as well. The CO government needs to grow a set.

The problem is the Colorado Government was against legalization in the first place. Governor Chickenlooper vowed to regulate the shit out of it, and was publicly ashamed of the vote to legalize marijuana a few years ago.

Honestly, the Colorado State Government is probably going to do anything in their power to prevent CBD from becoming big, because they are statists. And as Kushfreeman said, "Statists gonna state."

Oh, yeah. I forgot about Chickenlooper. Seems to me like they just need to be tossed out...by vote or by gun?

Honestly, it doesn't even matter anymore. These people are disgusting, violent parasites. Get rid of them however you can.

There's also likely some powerful behind the scenes $$$ pushing this legislation as CBD's cut into big pharma's profits. And 'Chickenlooper' ( @peterhendrick )... that was a good one!

This development is especially troubling to me, as the 7-figure sales job I've lined up may simply evaporate. It's small potatoes compared to the incredible health benefits these products provide, but if it weren't for self-interest, I doubt anyone would have much interest in anything at all. Please keep us posted, Kush.

Oh most certainly, I want to make this as public as possible. People are just learning about CBD. "They" are trying to kill it before it becomes a thing.

This is an outrage and clearly in violation with the state. If the state complies to the FDA than might as return marijuana/cannabis entirely as illegal status. Just another attempt to re-prohibit it's legalization.

For sake of being an adult I won't swear at how profane the FDA thugs are.

I do hope the people and individuals of Colorado are vigilant against these gangs. Keep strong! @Kushfreeman

FDA = Feds Destroying Alternatives

Ugh, CBD has been a lifesaver for me and I've been buying it legally from Colorado. Thanks for the update; I hope things work out for the best.

You're not wrong here, and in our view it was entirely anticipated that pharma would attempt to do so, which is why we created services like Hempslist and 1620 Solutions in 2015, so we could create viable alternatives to the precarious playing field they would ultimately create in favor of big pharma.

We understand and appreciate that CBD (and all other cannabinoids really) has helped so many to alleviate their maladies in a natural manner, and I find it an egregious affront to deny people in need of this medication--I've personally encountered people who have children with epilepsy who moved to CO specifically to have access to this medication.

We hope we can resolve this matter soon for the sake of those most in need once and for all.

Hey, everyone

We're glad to see you guys took interest in our attempt to try and inform the Industry and community as a whole, particularly Kushman for attending the event and sharing this information within the Steem platform.

Suffice it to say things are complicated and have only gotten more so since that event, so we at GrowHempColorado have decided to create some more content to better understand the situation and help create a dialogue as to how to best solve this matter.

We also believe we have some working solutions that, if refined with the help of the community, can render this abrupt and blatant over-reach of power moot.

More on that to come, so follow us on here and we'll keep you posted as this matter develops!
