Facism 6

As I have said before, the development of fascism, has in Canada's case, taken place over a relatively short period of time. During the swinging '60s a man from Québec who was a professional student, ran for office [he comes from a very wealthy family]. He became a member of Canada's parliament and very quickly moved to a position of power. As a testament to his resolve he made a personal charge against a man [he was minister for justice at this time]. The man I am speaking of days Pierre Elliott Trudeau. He would later become the prime minister of Canada. And in his position as prime minister he developed a new court system. This court was called the federal court of Canada. This new court came into being in 1978 [I may be slightly wrong here on the year], and it had all new rules, new laws, new procedures, and all the judge's were named to this court by the prime minister [leader of the country]. So you can see that it was being carefully developed by the prime minister to protect the government from the people. This would be in line with Napoleonic code. When Napoleon took over France, he noticed that the law protected the Crown from the people. So he changed the word Crown to "State". I have a lawyer friend, who has made it clear to me, that the only purpose of the federal court of Canada was to protect the government of Canada from the people of Canada and all of the lawyers of Canada knew it. It had never existed before. There was never any need.

But just to get back to the man who had charge brought against him under the national security act, he was given a code name Peter True. I was a student at University at this time. The trial was held in secret, the man's real name was kept secret, but it is known that he was executed. My lawyer friend was instrumental in finding this information, he has security clearance in Canada [what level of security pansies never told me]. However, since everything is a secret, and the newspapers tried very hard to get the trial information released. But there is the question of whether he was executed, spent the rest of his life in prison, or simply vanished.

I myself have been the federal court of Canada on three occasions. On the first occasion, the judge's name was Stevenson. I discover that he was from Fredericton NB. He would not allow me to speak to the allegations made against me by the Crown [I was charged with fraud] . I tried to speak to the allegation, but judge Stevenson kept saying that he could not rely upon anything I said or any document that I could produce to show my innocence to the allegation made against me I was exasperated. The lawyer representing the Crown stood up [a young man, trying to make his way in the lawyer world] and he said, as I remember, "you're honor [this is what judges are called in Canada] this case should be dismissed immediately". Judge Stevenson laughed. He said "I don't believe Mr. Wheaton is having a very nice time". There was a woman taker of records. She spun around in her chair to look at judge Stevenson seated behind her. She spun back around and stared at me. The young lawyer for the Crown was laughing. So I hold up a tape recording of a former hearing in Nova Scotia [where I was living when the Crown made the allegation against me]. Judge Stevenson said Mr. Wheaton you have made up everything on that tape. You have imitated all the voices and you have made up all of the names. Judge Stevenson said that he could not rely upon anything I said or any document that I may have that would protect me from the allegations made against me by the Crown [he repeated himself]. The lawyers said "your honor, please, dismiss this case". I had with me a letter from the Crown and I, rather loudly say, "this letter says that I was not living in this province when the Crown alleges that I committed fraud. Judge Stevenson is no longer laughing. He asked to see the letter. I was very lucky that the letter had a red flag on it [the flag of Canada] and as I approached the bench I tried to hand it to him. The taker of records quickly intervened and took it from me and passed it to the judge behind her. The overeager lawyer for the Crown protested. "Your honor I don't have that letter in front of me". Judge Stevenson took some time to lead my letter. He said "this letter appears to be genuine, unless Mr. Wheaton you has a color photocopier. [At that time color photocopier did not exist] he was as exasperated as I was earlier.

The judge took his time, he wasn't laughing anymore,. He said that he would think about this. And he would send me a letter about his decision. So out the door I went. I asked my lawyer friend about this. He was smiling throughout my entire recollection. Then he spoke. He said all the rights of the people of Canada are in the hands of the judiciary. The people of Canada have no rights at all. Save one. And that right is to answer to an allegation made against you by the Crown in criminal court [guilty or not guilty] . And that is the only right Canadians have. This change was made with our new constitution, of 1982, written by Pierre Elliott Trudeau. Mr. Trudeau called it the charter of rights and freedoms. But what he did not say is that he gave the rights of Canadians to the judges of Canada and not the people of Canada. No one in Canada noticed it. But the lawyers of Canada did. And I was very fortunate to have a lawyer friend. He has been invaluable to me. He has helped me a lot to find justice.

Some weeks go by. I received a letter from judge Stevenson. It was one page long. He said "I find for the claimant and allow the appeal". So of course I think I won. But I don't get my five thousand dollars returned to me [that was the total amount that the Crown has taken from me for committing fraud. In Canada, the judge can only say that it recommends to the Crown to return the money. And suggests that the Crown strike out the fraud charge made against me. But the Crown is not bound by any decision, by any court, of Canada. As fantastic as it sounds it is completely true. This is the greatest fascist state ever dreamed up.

In my next writing, a following prime minister of Canada, also from Québec, also trained under Napoleonic code as a lawyer, will do the most outrageous thing. He will turn a government department [with tremendous power] into a very sophisticated spy agency.
