CPS took 4 children and returned to the family only after 8 months. Why parents can not sign a voluntary agreement on the transfer of children to the CPS.
Hello everyone! I already wrote, that CPS can take away the child because of a trifle, it can be a bruise received during the game, an anonymous complaint, dirt in the apartment, an empty refrigerator. Yesterday I learned about one story, after reading it - in the list of reasons you can add another.
In St. Petersburg, CPS with police detained two teenagers, 10 and 13 years old for traveling in the subway during the day without parents, and the next day came to the family and seized two kids. As a result, the mother of the family had a stroke, parent complaints in instances did not give anything, and to return all four children was only 8 months later the lawyers of the Public Commissioner for family protection in St. Petersburg.
In the spring of 2017, two children were traveling on the subway from a walk in the city center home. At the metro station Ploshchad Vosstaniya to teenagers approached an unknown woman, probably an employee of guardianship, scolded one of the boys for the dirt on his knees and took to the police Department at the Moscow station. Police officers drew up an act of neglect (in previous posts I wrote, that CPS often uses the concept of "neglect" in order to take children from the family) and sent the children for examination to the Center for medical and social rehabilitation. And the next day the family was employees of CPS. The father of the children was at work, at home was only a mother with two kids. In the apartment CPS staff told the mother, that she lives poor and does not cope with parental responsibilities — so in order not to deprive them of parental rights, CPS offers to temporarily place all children in an orphanage, and parents must make repairs in the apartment and find a high-paying job. What kind of arguments used CPS, is unknown - but the mother signed consent to the temporary placement of children in an orphanage (and CPS of course promised her, that she will be able to pick up children on demand). And this is despite the fact, that the family has never been on any accounts as needy or unfavorable. This is another point, about which I wrote in previous posts - you in any case should not sign a voluntary consent to the transfer of children anywhere. All promises that you can bring the children home at any time are lies.
But later in the documents of the CPS appeared a certificate stating, that the mother allegedly abuses alcohol, but in fact there is no single certifying doctor's notes, hospital and so on. Parents come to their senses and tried to return children-but not here something was. The representative of the CPS gave them an ultimatum: first they need to show a certificate of income of the mother, give "specialists" to check the family's housing conditions, even talk to the father— without meeting these requirements CPS children will not be returned. From experiences mother had a stroke, her husband looked after her, taking a vacation at work and as a result almost lost not only work, but also the opportunity to legally be in Russia (he is a citizen of Moldova). Only after long eight months parents heard about The public Commissioner for family protection in St. Petersburg and appealed to the "hot line".
Employees of the orphanage, where the boys were locked, tried to refuse the return of children, referring to the requirements of guardianship: "we never hold anyone. But if the mother wants to take the children, she must first do what she is asked to the guardianship", - said the staff of the shelter. Parents went to the media, hired lawyers. The lawyer pinned the CPS to the wall arguments about the illegality of the requirements of any certificates in the case when people themselves wrote a statement about the temporary placement of children in a state institution, the CPS staff confirmed that parents can "at any time" to pick up children. Parents did this.
In this story, everything is significant: the illegal actions of the CPS and the illiteracy of parents, who not only immediately did not let the custody down the stairs, but almost a year could not hire lawyers and apply to the media, but just waiting...
It is interesting, that the concept of "neglect" is defined differently in different countries and areas. For example, in the Chechen Republic there is a rule, that when a child is found by a police officer, under the threat of a criminal case, is obliged to find his parents or relatives and give it to them within the next two hours. But in Russia it's just an excuse for the CPS to draw up an act on child neglect and take children from the family.
