Parte I
Constitutional Law
This article guarantees the rights of citizens to receive fair treatment and equal legal certainty. This is public law because it regulates the relationship between the state and citizens regarding guarantees of justice.
State Administrative Law
This law regulates traffic order and safety, including imposing sanctions on violators. This is public law because it relates to the regulation of public interests and the authority of the state in enforcing rules on the highway.
Civil Law
This article regulates legal obligations or relationships arising from agreements or laws between individuals. This is private law because it regulates the rights and obligations of individuals in contractual relationships.
Family Law
This law regulates aspects of marriage such as the validity of marriage, husband-wife relationships, and children's rights. This is included in private law because it concerns personal relationships within the family.
Public Law involves the relationship between the state and individuals or the general public, usually to protect the public interest and regulate social order.
Private Law regulates relationships between individuals or groups on a personal basis, with a focus on private (civil) rights and obligations.
Law Number 35 of 2009 concerning Narcotics
- This law regulates the control, supervision, prevention, and imposition of sanctions against violations related to narcotics abuse. Example:
Article 111: Regulates criminal sanctions against people who plant, maintain, or distribute class I narcotics.
Reason: This law is included in criminal law and is public law because the state has a responsibility to protect society from the dangers of narcotics abuse which has a broad impact on public order.
Law Number 19 of 2016 concerning Information and Electronic Transactions (UU ITE)
UU ITE regulates criminal acts related to the use of information technology, such as hate speech, defamation, or the spread of fake news via the internet.
Reasons for including public law: This law regulates violations that impact the wider community, with the state tasked with enforcing the law and imposing sanctions on violators.
Parte II
Criminal law is interesting because it combines elements of justice, case complexity, social impact, development dynamics, and moral values. This branch is not only important for law enforcement, but also reflects how society works together to create a safe and orderly environment.
Parte III
I once experienced theft and robbery in my residence. Late at night when everyone in the housing complex where I live was sleeping, thieves entered the housing complex where I live and robbed the area where we live. They stole our valuables such as cash, cellphones, and laptops, then immediately left the housing complex.
The next day after the incident, my neighbors in the housing complex and I reported the case to the police.
Based on the nature of the act, robbery, jumping over someone’s fence, stealing someone’s property and threatening the life of another person with weapons such as guns, knives etc to take their valuables are classified as crimes under the Nigerian criminal law because they involve breaking the law to harm individuals if they do not guard their property.
Based on the circumstances of involvement, in criminal law, the state ensures that the offender maintains public order, in this case the state represents the police in the case while I and the other tenants complete the matter to ensure that justice is served.
Based on punishment because the criminal law is to maintain crime and order in our society, the suspects are required to face the punishment of the law for their actions and to prevent further harm to others in the society.
