While the argument could be made re. citizenship and constitutional rights, the People who drafted the Constitution actually did talk about "shared responsibility" when it comes to reporting/recording the News/History. The "So called 4th estate" and the leniency regarding it.
If the Government wants to proceed they would indeed be required to charge EVERY other U.S. Reporter/Journalist that is a citizen with high crimes against the U.S. Government.
