Documentary Review Making a Murderer P2 E5 What + Why = Who

in #story6 years ago

Regarding the EDTA and the punctured blood vial, it is interesting that Kathleen abandons that theory inherited from Buting and Strang. Steven claims that he left all kinds of blood in his bathroom in his trailer that was cleaned up by an unknown person. This seems to be a better source for the blood considering the blood on the floor of the rav4 was flaky, like it was scraped from a bathroom sink after it dried. They take the whole sink with them to conduct more tests.

As part of judge Duffin's reversal of Brendan's conviction he stipulates Brendan should be released on bond, denies the State's motion to deny release, and then puts a hard deadline for said release. Attorney general of Wisconsin Schimel then files an emergency appeal to the 7th circuit to overturn Duffin's order. A three judge panel out of Chicago issues a stay keeping Brendan in jail. It simply granted it without offering an opinion. This is the same court that will ultimately decide whether or not to overturn judge Duffin's order. Schimel states his urgency in keeping Brendan in jail is for the Halbach family. Objectivity seems to be thrown under the bus here, he has no doubt about who killed her. Is he psychic?

Kathleen continues her discussions with experts. We wonder if she is wasting time because of all the filthy judges and lawyers infesting our justice system. We wonder how Schimel thinks blood flakes without blood stains are found on the carpet of the driver's side in the rav4. Yup, no blood stains on the carpet were found. But dried blood flakes were. This is just the kind of thing that would make an intelligent person think, but Schimel doesn't appear to be the pensive type here.

Kathleen also makes a brilliant point about the parking light on the rav4. Teresa's ex boyfriend is friends with her roommate. In fact he moves into the house after Teresa disappears having all kinds of access to her things. He also attached himself to the broken parking light. He says she filed a claim on it but pocketed the money without having it fixed. Kathleen points out that lies are often elaborate like that. She checks with the insurance company. They confirm she made no such claim. It seems to Kathleen this front parking light was broken driving the car onto Avery's property, and Ryan has connected himself to that parking light. On missing person flyers that he made, there is no mention of a broken light on the car.

This episode shows Schimel telling a reporter how vast his resources are on the State level for cases like Brendan's. Nirider and Drizin now prepare for a hearing with the 7th circuit, on step below the United States supreme court. They do mock hearings and prepare heavily for this hearing. In our personal opinion such preparation is important but the facts of the case are more important than researching specific judges and what questions they may ask. Knowing the interrogations inside and out, with statistics about them at your fingertips, being able to quote pertinent cases, these things should be mastered cold.
