The Diary Game

I salute you all my Steemians.
It was a very cool and beautiful day in court.
It was one court session after the other and it is fair to say my day in court was enjoyable and it was equally a good day for justice in the interest of all.
These various sessions were very heated which is a good thing for young and aspiring lawyers like me and it is equally indicative of the fact that both counsels and judges came ready for today's business.

I picked out a few things from these court sessions which I would like to share with us all.
During one of the sessions,which was a criminal matter a counsel stated that the accused person is guilty of the all charges and claims against him and so should be convicted even without being given the opportunity to be heard because according to counsel the evidence before the court was so real and overwhelming that it needed no other documents to support it.

In response the opposing counsel raised an objection by stating this Latin maxim "Audi alterem partem" which means no one should be convicted without being heard or let the other side or party be heard.
His objection was upheld by the judges and the matter adjourned to a further date for ruling.
I left the court room today feeling satisfied and excited about the future in legal practice.
In another case where a guy who had once been tried and acquitted on an issue was brought to court again for the same issue and the state Counsel alongside the opposing counsel were of the opinion that regardless of the fact that this guy had once been tried and acquitted for a similar offence it didn't mean that he was not going to pay for committing an offence in the current case at hand but his lawyer or counsel responded by stating the position of the law on an issue like this which goes thus...autre fois acquit meaning an individual had once been tried for a similar offence and was acquitted so his client could not go to prison,this reply single handedly end proceedings and a ruling was passed instantly in favor of the accused,the atmosphere after the verdict of this case was generally a good one.

It was after these cases that I had an understanding of certain legal issues I use to think were normal.
Before I thought that an individual could be tried and retried for the same offence as many times as possible even if he was acquitted before he could still be tried for the same issue and convicted but I discovered today that it was not the case,it's really true what they say...Learning never ends.

Wow maitre this a great presentation i must say. Those court sessions are usually interesting to to be part. Thanks for defining some of the legal terms but some were still difficult for me to understand. Thanks we are looking forward in reading from you sir
