Assalamu Alaikum friends. Wishing everyone good health. Hope you all are well. By God's grace I am fine too. Today I am here to participate in a wonderful learning competition organized by our teacher @anasuleidy. The Topic of this contest is SLC22-W2 / Branches of Law. So this is a very important competition where we can learn some important things. Below are some questions that I will answer correctly. So let's get started.
Part I - According to what was explained in class, according to the law or laws of your country, indicate two examples of public law and two examples of private law, and explain why you consider that these rights are part of public law and private law. |
---|
I am a citizen of Bangladesh so the examples of public and private law are analyzed in the light of Bangladeshi law.
Examples of Public Laws | Source |
---|
Criminal Law :
Example | Bangladesh Penal Code, 1860 (Penal Code, 1860). |
---|
Explanation :- Criminal law defines the offense of a person and the punishment applicable to him. It operates in the interest of the state and the state takes punitive action against the offenders. As this law is enacted to protect the interests of the state and society, it belongs to public law.
Constitutional Law :
Example | Constitution of Bangladesh, 1972. |
---|
Explanation :- The constitution regulates the structure of the state, civil rights and the functioning of the state. It balances the fundamental rights of the people and the powers of the state. It belongs to public law as the state itself enforces the rules of this law.
Examples of Personal Laws | Source |
---|
Family Law :
Example | Muslim Family Laws Ordinance, 1961 (Muslim Family Laws Ordinance, 1961). |
---|
Explanation :- This law regulates marriage, divorce, inheritance, and family matters. It is applied to the individual's private life and the state usually does not directly interfere with it. So it is part of personal law.
Civil Law :
Example | Civil Procedure Code, 1908. |
---|
Explanation :- This Act deals with financial or contractual disputes between individuals or institutions. It is enacted to protect the interests and rights of individuals, hence it belongs to personal law.
So Public law generally protects the larger interests of the state and society, such as criminal and constitutional law. On the other hand, private law protects the interests of individuals or specific groups, such as family and civil law.
Part I - You must select two laws from your country, you must place them in one of the branches of law explained in class (or with which of the branches of law it is related or similar), and you must also explain why you place that law in that specific branch. |
---|
Below we select two laws of Bangladesh and analyze them in relation to the branches of law explained in class.
Bangladesh Labor Act, 2006
Branch of Law | Public Law → | Labor Law |
---|
Reason :- Bangladesh Labor Law defines the rights and responsibilities of working people. It regulates the relationship between the worker and the employer in the workplace. Such as salary, leave, working hours and safety etc.
The state enforces the law and can intervene in court to protect workers' rights. So it is a part of public law.
Muslim Family Laws Ordinance, 1961
Branch of Law | Personal Law → | Family Law |
---|
Reason :- This law regulates Muslim marriage, divorce, inheritance, and guardianship of children.
It governs the individual's personal life and family relationships. Although the state may intervene in some cases (eg, divorce registration or inheritance disputes), it mainly applies to individuals and families. Hence it is part of personal law.
The Bangladesh Labor Act, 2006 is part of public law as it ensures the active role of the state in protecting the interests of workers.
The Muslim Family Law Ordinance, 1961 is a part of personal law as it governs the personal relationship of individuals and religious norms.
These laws play an important role in ensuring the rights and responsibilities of people at various levels of society.
Part II - Of all the branches of law (explained in class or that you know and have not been explained), which one do you find most interesting and why? |
---|
Of all the branches of law, Criminal Law is the most interesting to me. There are some special reasons behind this attraction which are analyzed below.
Crime Prevention and Punishment | Source |
---|
Criminal law is essential to maintain stability in society. It is a branch of law dealing with crime and punishment. The main objective of this law is to prescribe punishment for people who commit crimes and keep the society free from crime.
- Reason: It is very interesting to analyze how it determines the punishment according to the nature of the crime. It offers not only punitive but also crime prevention measures.
Role in administration of justice | Source |
---|
Criminal law helps strike a balance between the offender and the victim.
- Reason : Criminal law is very important in Bangladesh for crimes like rape, murder, and theft. In these cases the judicial process of criminal law ensures justice.
To maintain order in society :
Criminal law creates a systematic framework for society. This ensures that law breakers are punished appropriately and others learn from the example.
- Reason : I am fascinated by how these systems of policing and crime control policies work.
Complex processes and investigations :
Criminal investigations, evidence gathering, and judicial processes in criminal cases are highly complex and strategic.
- Reason : The methods followed to prove a crime, such as forensic investigation or witness statements, are highly exceptional and challenging.
Social and psychological effects | Source |
---|
Criminal law has a profound impact on the lives of people in society. It not only controls criminals, but also helps in maintaining human behavior and moral standards.
- Reason : It is not just punitive but a social process to guide people in the right direction.
So criminal law is most interesting to me because it plays the most effective role not only in punishment but also in maintaining order in society, controlling crime and establishing justice. This is important both from a human and technical point of view. How the law can rehabilitate criminals and provide justice to victims, through this, deeply impresses me.
Part III - We have all had or experienced moments within one of the branches of law. So you must tell us about your own or someone else's experience but of which you have full knowledge and can adapt or compare it with one of the types of law explained in class. You must describe this legal situation in detail and explain why you consider it part of that right. |
---|
I am giving an example based on the experience of a friend of mine which is related to Family Law. Details of my experience;
My friend's name is Rahim. There was a major problem in his family life, when his parents got into a disagreement over the division of their property. Rahim's family was supposed to share the property according to inheritance laws. But his father did not want to give part of the property to his younger brother. This creates conflict in the family and eventually leads to court cases.
Rahim's family filed a claim in court for distribution of inheritance under the Muslim Family Law Ordinance, 1961. The judge ensures the proper distribution of property according to the rules of family law. At the end of the judicial process, the family reaches a settlement and the property is distributed fairly.
Law and Analysis | Source |
---|
This situation falls under family law because,
Distribution of Inheritance : It completely regulates personal relationships and distribution of property within the family.
State intervention : Since this was resolved through the courts, the state played the role of neutral judge here.
Why it is part of family law :
Family law is primarily based on the relationship between family members and their rights and responsibilities.
In this context, inheritance distribution is a family law matter, as it is used to resolve property disputes between family members.
So Rahim's experience shows that family law not only solves personal problems but also plays an important role in establishing justice in the family. It is helpful in preventing family breakdown and maintaining social order.
Finally, law is essential to ensure order, justice and good governance in society. In the case of Bangladesh, public laws such as criminal law and administrative law serve to maintain order in the state and society. Whereas personal law, such as family and civil law, preserves relationships and rights between individuals. Criminal law plays a special role in the prevention and punishment of crimes which are of great importance to society. On the other hand, family law protects relationships by settling family disputes. Each branch is complementary to each other in maintaining law and order and their proper application is important for the proper development of the society. So I am very happy to answer all questions from my point of view.
Finally, it is a very important learning competition. Here we have learned important topics about law. Thanks a lot to our teacher for that. So I am Inviting my lovely Steemian friends @ulfatulrahmah, @kouba01, @selina1 to Participate in this Competition.
